Welcome to You Hear Us ("Platform"), accessible at youhearus.com. These Terms and Conditions ("Terms") govern your access to and use of the Platform, which is operated by You Hear Us ("we," "us," or "our"). These Terms apply to all users of the Platform, including musicians and curators. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Platform.


1. Platform Overview The Platform serves as an online marketplace where musicians may submit songs for promotional consideration by independent third-party curators. Users can register as either a musician or curator, each having distinct access and functionality within the Platform. We act solely as an intermediary and do not guarantee the outcome of any promotional effort.


2. Account Registration To use most features of the Platform, users must register and create an account. Users must be at least 18 years old or the legal age of majority in their jurisdiction. You are solely responsible for safeguarding your account credentials and for all activities that occur under your account.


3. Payments and Fees All financial transactions on the Platform are processed through Stripe. Musicians pay:

        - A fee to upload and list songs on the Platform.


        - Fees to individual curators for promotional services they choose to offer. All pricing is disclosed prior to payment. All sales are final, and we do not issue refunds once a transaction is completed, except as required by         applicable law. We do not set or control the fees charged by curators.


        - Music Submission Guidelines By uploading content, musicians affirm that

        - They hold the legal rights to distribute and promote all submitted materials.

  • Their content does not infringe on any third-party rights and does not contain illegal, hateful, or harmful content. We reserve the right to remove any content that violates these Terms, without prior notice or refund.

  1. Curator Obligations Curators agree to:

  • Listen to submitted content before making a decision.

  • Provide clear and honest responses when applicable.

  • Comply with all applicable Payola and promotional disclosure laws. Curators act as independent contractors, and we do not endorse or verify the conduct or decisions of any curator. Breach of these obligations may result in account suspension or removal.

  1. Prohibited Conduct Users agree not to:

  • Use the Platform for unlawful, misleading, or malicious purposes.

  • Interfere with the proper operation of the Platform.

  • Misrepresent themselves or impersonate others.

  1. Intellectual Property Users retain ownership of their uploaded content. By submitting content, users grant us and applicable curators a non-exclusive, royalty-free license to access, stream, and use the content solely for the purpose of promotion through the Platform.

  2. Disclaimer of Warranties & Limitation of Liability The Platform is provided on an "as is" and "as available" basis. We make no guarantees regarding promotion outcomes or curator actions. To the fullest extent permitted by law, we disclaim all warranties and are not liable for any damages arising from Platform use, including but not limited to data loss, service interruptions, or user disputes.

  3. Modifications to Terms We reserve the right to modify these Terms at any time. Updated Terms will be posted on the Platform. Your continued use constitutes acceptance of any changes.
